By accessing or using ByflareMX, you confirm that you are at least 13 years old and capable of forming a binding contract. If you are using the service on behalf of an organization, you agree to these Terms on behalf of that organization.

2. Use of Service

You may use the service only in compliance with these Terms and all applicable laws. You are solely responsible for your usage, including email content and recipients. You must not use the service for spam, abuse, or illegal activity.

3. Account & Security

You are responsible for maintaining the confidentiality of your account credentials. ByflareMX is not liable for any loss or damage from unauthorized access to your account.

4. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your data.

5. Intellectual Property

All content and software associated with ByflareMX is the property of Byflare Technologies or its licensors. You may not copy, modify, or distribute any part of our services or content without explicit permission.

6. Limitations of Liability

To the maximum extent permitted by law, Byflare Technologies shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or in connection with your use of the service.

7. Modifications to Service

We reserve the right to modify, suspend, or discontinue any part of the service at any time without notice. We are not liable for any resulting disruption or loss.

8. Changes to Terms

These Terms may be updated or modified by us at any time, at our sole discretion. Changes will take effect immediately upon posting. Continued use of ByflareMX after changes constitutes your acceptance of the updated Terms.

These Terms of Service are subject to change before public launch and at any time thereafter as we see fit. The latest version will always be published at this URL and is legally binding.

9. Refund Policy

ByflareMX is a subscription-based service offering monthly and annual billing. All charges are processed in advance at the start of the billing cycle and are non-refundable, except as outlined below.

We do not offer refunds for:

• Partial use of a subscription period
• Downgrades during an active billing cycle
• Failure to cancel before a renewal date

You may cancel or downgrade your plan at any time. Changes will take effect at the end of your current billing period, and you will not be charged again unless you resubscribe.

Refunds may be issued at our discretion in the following cases:

• Accidental duplicate charges
• Unintended auto-renewals reported within 7 days, provided the service was not actively used during that time
• Extended service disruptions or outages that prevent access to core functionality

If you believe you qualify for a refund, please contact support@byflaretech.com within 7 days of the charge. We typically respond within 2–3 business days.

Accounts found violating our Terms of Service, abusing the platform, or engaged in prohibited use (e.g. spam, phishing, harassment) are not eligible for refunds.

This policy is designed to balance fairness for users with the sustainability of the platform. We reserve the right to revise these terms at any time.

10. Termination

We may suspend or terminate your access to the service at any time for violation of these Terms or any applicable law. Upon termination, your right to use the service will immediately cease.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Disputes will be subject to the exclusive jurisdiction of the courts in Chennai, India.
